Privacy Notice Concerning Your Personal Data
This notice explains how the personal data of our foundation members, donors, and the people and organisations that support or work with our foundation are processed under the Personal Data Protection Law.
Information and Consent Concerning the Protection of Personal Data
Following the publication of Personal Data Protection Law No. 6698 in the Official Gazette on 7 April 2016, Lokman Hekim Health Foundation, acting as data controller, is required to inform you that personal information provided to us may be recorded, stored, updated, classified, disclosed or transferred to third parties, and otherwise processed as described below where permitted or required by law.
An exception has been foreseen for personal data processed before 07.04.2016 and a period of 2 years has been given to bring these data into compliance with the Law. During this period, it has been stipulated that data that is found to be contrary to the Law must be immediately deleted, destroyed or anonymized.
The Law states that lawful consents received before 07.04.2016 will be deemed to be in compliance with the Law at the end of 1 year, unless a contrary declaration of intent is made.
This personal data is given directly by the User by any means in physical or virtual environment;
- Name and surname,
- Contact information such as telephone number (home and work), address, e-mail addresses, fax,
- Gender
- Date of birth
- Education level
- Relationship/marital status
- Areas of interest/satisfaction, complaints
- Social media preferences
- Likes and preferences
- Event participation or ticket purchasing actions and habits, Lalekart membership preferences,
- Payment information
- Educational and work experience history/resume information/career goals
- Job title/profession/place of work
- Photographs constituting general meeting and event visuals within the scope permitted by legal regulations,
These are personal data that include topics such as.
In addition, the User's application usage information obtained from other channels/indirectly, data to be obtained during logins through the website, blog, application, etc., e-bulletin reading/clicking movements, preferences in channels logged in using the membership username and password, data containing the transactions performed and navigation time and details, location data, data provided by public data banks, the User's access to the website or through social media platforms (e.g. social networking sites such as Facebook, Google Plus, Spotify, Instagram). If connected to the applications, personal data may be collected through methods such as the shared profiles and data of the User and his friends on these social media accounts, navigation/traffic information on websites and applications.
In addition, where required by applicable legislation, personal data may be retained to fulfil legal obligations.
Special Categories of Personal Data: These are categories directly related to a person's privacy and exhaustively listed in the Law, including race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, association, foundation or trade-union membership, health or sexual life, appearance and clothing, criminal convictions, and genetic and biometric data.
Explicit consent is required for the use of other special personal data, except for health and sexual life. If the law requires receiving this data, then explicit consent is not required. In cases where health and sexual life information is stored by health service institutions within the scope of the service, explicit consent is not required.
Purposes of Processing Personal Data
User's personal data;- Providing opportunities such as membership, invitation, benefiting from events and carrying out all necessary actions to make them available to the User,
- Providing information about the services to be offered and their content,
- Evaluating personal data and information in statistical studies without disclosing identity in order to improve services,
- Determining the User's preferences and needs and shaping and updating the services to be provided to the User within this scope,
- Informing LOKMAN HEKIM HEALTH FOUNDATION, its sponsors/supporters about the contents, opportunities and innovations related to its activities,
- Informing the User about the information, events and services he/she will request,
- Evaluating complaints and applications that the User may make,
- Proposing new events and services that may interest the User according to their preferences,
- Depending on the User's preference, the User can be reminded of the contents and opportunities that the User likes, may want to access again, and would be pleased to be reminded of,
- To produce anonymous, total and statistical information by conducting research on user profiles, interests and behaviors based on the information given by the user, and to develop the content of LOKMAN HEKIM HEALTH FOUNDATION by combining this information with the information of other members, such as certain age groups and the percentage of male and female visitors,
- Conducting research on user profiles, interests and behaviors based on the information provided, and developing special content and opportunities for the profiles to be created,
- Processing of the User's personal data, preferences, transactions and browsing time and details in the channels where he/she logs in using his/her username and password, together with other data obtained,
- Conducting analysis and auditing to improve the quality of services offered and to develop new services,
- Managing the application(s),
- The identity can be determined by matching with other data belonging to the User obtained through other channels explained in the "Method and Legal Reason for Collecting Personal Data" section above, and the data can be used in line with the purpose for which it was obtained,
- Transferring data for storage,
- Copying/backing up data to prevent data loss,
- To notify the User and send electronic messages about events that LOKMAN HEKIM HEALTH FOUNDATION owns, supports or wants to announce,
- Sending commercial electronic messages with separate approval in accordance with legal regulations,
- Scholarship applications,
- Retaining the CVs, interview notes and reference-check records of job applicants so that suitable positions may be offered, and retaining corresponding records for former employees where relevant; providing efficiency and performance references to new employers upon request,
- Union membership information of LOKMAN HEKIM HEALTH FOUNDATION employees,
- For other purposes to be notified to the User while obtaining the information,
- To ensure the fulfillment of legal obligations, as required or required by legal regulations,
- Processing personal data in other ways permitted by the KVKK.
Persons/organizations to which personal data may be transferred for the purposes stated above; Persons or organizations permitted by the Foundations Law and other legislative provisions; These are, but are not limited to, universities, schools, NGOs, public institutions and organizations, and real and legal persons operating in the private sector, with whom we are in mutual coordination in order to achieve our foundation goals, program partner organizations from which we receive services and cooperate in order to carry out our activities, domestic / international institutions and organizations, banks and other 3rd parties.
Method of collecting personal data; Your personal data may be collected verbally, in writing or electronically through channels such as the Foundation's General Directorate, Branches, Local branches, coordination and service centers in other cities and universities, representative offices, and joint ventures in joint activities with other NGOs and/or organizations.
Your rights in accordance with Article 11 of KVKK;
By applying to our Foundation, your personal data; a) to learn whether it has been processed or not, b) to request information if it has been processed, c) to learn the purpose of processing and whether it is used in accordance with its purpose, d) to know the third parties to whom it has been transferred domestically/abroad, d) to request correction if it has been processed incompletely/incorrectly, e) to request deletion/destruction within the framework of the conditions stipulated in Article 7 of the KVKK, f) to request notification of the transactions made in accordance with clauses (d) and (e) above to the third parties to whom it has been transferred, g) exclusively through automatic systems. You have the right to object to the emergence of a result against you due to the analysis, g) to request compensation for the damage in case you suffer damage due to illegal processing. In this case, you must first apply to our foundation as the data controller, if your application is rejected, you must apply to the Personal Data Protection Board in accordance with Article 14 of the Law after 30 days, and if your application is not answered, you must apply to the Personal Data Protection Board after 60 days.
This declaration and approval form is an annex and an integral part of the Disclosure Form Regarding the Personal Data Protection Law No. 6698 and the Rights Within the Scope of This Law.
I declare that I give explicit consent, within the scope described in this notice, to the processing of personal data and special-category personal data that I have provided to the Foundation or that the Foundation has obtained through its procedures. This includes collecting, recording, storing, amending, updating, periodically reviewing, reorganising, classifying and retaining such data for the period required by the processing purpose or applicable law; sharing it, where legally or operationally necessary, with service providers, authorised public institutions and organisations, and third parties in Türkiye or abroad; and transferring it abroad where legally or operationally necessary.
I confirm that I have read and understood this declaration and consent form, whether presented face to face or through a durable medium such as text message, email, the internet, disk, CD, DVD or memory card, in accordance with Article 4(c) of the Distance Contracts Regulation, and that a declaration obtained through these means is valid.
